Buona giorno a tutti,
Vorrei chiedere un parere in merito alla nostra situazione, relativamente all'acquisto di un appartamento da costruttore.
A Marzo 2019, abbiamo firmato un preliminare, nel quale veniva indicato che la consegna sarebbe avvenuta entro il mese di Settembre 2020, riportando seguente testo "Il suddetto termine non è essenziale e potrà essere derogato per cause di forza maggiore e comunque indipendenti dalla società venditrice, tali intendendosi a titolo esemplificativo ma non esaustivo scioperi, gelo, avversità atmosferiche, ritardi da parte di enti, ecc ecc..".
Nello stesso, veniva pattuito che avremmo versato una caparra per 10mila euro + 20mila come acconto avanzamento lavori.
A maggio 2020 abbiamo venduto l'appartamento nel quale vivevamo, e dalla somma ricevuta, abbiamo dato al costruttore, la somma di 93600,00 euro, per un precedente accordo "verbale" che, a fronte di questo versamento, avremmo dimezzato le spese di allacciamento, dal 2% all'1%, oltre ad un buon trattamento per i lavori di extra capitolato.
A ridosso del pagamento, l'impresa ha cambiato idea sulla scontistica delle spese di allacciamento, decurtandomi qualche spesa per i lavori extra, (circa 2000€).
Ovviamente, io ho comunicato il mio disappunto via mail, comunque procedendo in tale accordo.
Inoltre, l'arredamento della casa venduta, è stata posizionata un un magazzino, a pagamento, con un contratto da Maggio a Settembre, proprio in ottica delle previsioni del preliminare.
Adesso, dovendo mantenere il deposito, mi trovo a dover pagare circa 250€ al mese di affitto, per mantenere il posto.
Vorrei chiedere 2 cose:
- Abbiamo versato un ulteriore acconto di 93.600,00 con regolare bonifico e seguito da fattura del costruttore, ma non abbiamo ricevuto nessuna fidejussione su questo importo, in quanto non era un versamento previsto nel preliminare.
E' corretto?
- proprio ieri è "scaduto" il termine (Settembre) e non è stato rispettato.
E' possibile tutelarsi per questo ritardo ed eventualmente chiedere un risarcimento?
